THE INDIAN PENAL CODE (UTTAR PRADESH AMEND­MENT) ACT, 1970

     Passed in Hindi by the Uttar Pradesh Legislative Council on August 28, 1969 and by the Uttar Pradesh Legislative Assembly on April 30, 1970.

[Received   the assent of the President on July 17, 1970 under Arti­cle 201 of the Constitution of India, and was published in the Uttar Pradesh Gazette, Extraordinary, dated July 29, 1970.]

     An Act further to amend the Indian  Penal Code   in its application to Uttar Pradesh

It is hereby enacted in the Twenty-First Year of the Republic of India as follows :

2. Amendment of Section 103 of Act XLV of 1860 in its application to Uttar Pradesh.—In Section 1°3 of the Indian Penal Code in its application to Uttar Pradesh, after clause Fourthly, the following clause shall be inserted, namely :

"Fifthly.Mischief by fire or any explosive substance committed on—

(a) any property used or intended to be used for the purpose of Government or any local authority or other corporation owned or controlled by Government ; or

(b) any railway as defined in clause (4) of Section 3 of the Indian Railways Act, 1890 (Act IX of 1890) or railways stores as defined in the Railways Stores (Unlawful Possession) Act, 1955 (Act U of 1955) ; or

(c) any transport vehicle as defined in clause (33) of Section 2 of the Motor Vehicles Act, 1939 (Act IV of 1939)."
