(First Amendment) Rules, 2011

In pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of notification No. M-31/88-2011-75 Oshadhi dated. July 29,2001 :

In exercise of the powers conferred by the proviso to Article 309 of the Constitution, the Governor is pleased to make the following rules with a view to amending the Uttar Pradesh State Drug Control Gazetted Service Rules, 1995—

The Uttar Pradesh State Drug Control Gazetted Officers Service
(First Amendment) Rules, 2011

1. Short title and commencement.—(1) These rules may be called The Uttar Pradesh State Drug Control Gazetted Officers Service (First Amendment) Rules, 2011.

(2) They shall come into force at once.

2. General Amendment.—In the Uttar Pradesh State Drug Control Gazetted Officers Service Rule, 1995, hereinafter referred to as the said rules, for the words “The Uttar Pradesh State Drug Control Gazetted Officers Service” wherever occurring including the preamble, the long title, sub-rule (1) of rule 1, rule 2 and clause (j) of rule 3, the words “the Uttar Pradesh Food and Drug Administration Department Gazetted Officers’ (Drugs) Service” shall be substituted.

3. Amendment of Rule 3.—In the said rules, in rule 3—

(a) for existing clause (a) set out in Column-1 below, the clause as set out in Column-2 shall be substituted, namely—

(a) “Appointing Authority” in respect of the posts of Inspector of Drugs and Senior Inspector of Drugs means the State Government and in respect of all other posts means the Governor;

(a) “Appointing Authority” in respect of the post of Inspector of Drugs means the Commissioner, Food and Drug Administration Department, Uttar Pradesh and for the remaining posts in the services means the Governor;

(b) the existing clause (e) shall be omitted.

 

4. Substitution of Rule 5.—In the said rules, for existing rule 5 set out in Column-1 below, the rule as set out in Column-2 shall be substituted, namely—

5. Source of recruitment.—Recruitment to the various Categories of post in the service shall be made from the following sources—

(1) Deputy Drug Controller—

(1) Joint Commissioner (Drugs)—

By promotion from amongst substantively appointed Assistant Drug Controllers, who have completed two years service as such on the first day of the year of recruitment.

By promotion from amongst substantively appointed Deputy Commissioners (Drugs) who have completed four years service as such on the first day of the year of recruitment.

(2) Assistant Drug Controller —

By promotion from amongst substantively appointed Senior Inspector of Drugs who have completed three years service as such on the first day of the year of recruitment.

By promotion from amongst substantively appointed Assistant Commissioners (Drugs) who have completed four years service as such on the first day of the year of recruitment.

(3) Senior Inspector of Drugs—

By promotion from amongst substantively appointed Inspector of Drugs who have completed four years service as such on the first day of the year of recruitment.

5. Substitution of Rule 8.—In the said rules, for existing rule 8 set out in Column-1 below, the rule as set out in Column-2 shall be substituted, namely—

8. Academic qualification.—A candi-date for direct recruitment to the post of Inspector of Drugs must possess such qualifications as have been prescribed under the rule made by Central Government in accordance with the provisions contained in Section 21 of Drugs and Cosmetics Act, 1940.

Academic qualification.—A candi-date for direct recruitment to the post of Inspector of Drugs must possess such qualifications as have been prescribed under rule-49 of the Drugs and Cosmetics Rules, 1945 made by the Central Government in accordance with the provisions contained in section 21 of the Drugs and Cosmetics Act, 1940.

6. Amendment of Rule 15.—In the said rules, in rule 15, for existing sub-rule (3) set out in Column-1 below, the sub-rule as set out in Column-2 shall be substituted, namely—

(3) The Commission shall prepare a list of candidates in order of their proficiency as disclosed by the marks obtained by each candidate in the interview. If two or more candidates obtain equal marks, the Commission shall arrange their names in order to merit on the basis of their general suitability for the service. The number of the names in the list shall be larger but not larger by more than 25 percent than
the number of vacancies. The Commission shall forward the list to the appointing authority.

(3) The Commission shall prepare a list of candidates in order of their proficiency as disclosed by the marks obtained by each candidate in the interview. If two or more candidates obtain equal marks, the Commission shall arrange their names in order to merit on the basis of their general suitability for the service. The Commission shall forward the list to the appointing authority.

7. Amendment of Rule 16.—In the said rules, in rule 16, for existing sub-rule (1) set out in Column-1 below, the sub-rule as set out in Column-2 shall be substituted, namely—

(1) Recruitment by promotion shall be made on the basis of seniority subject to the rejection of unfit through the Selection Committee to be constituted in accordance with the Uttar Pradesh Constitution of Departmental Promotion Committee (for posts outside the purview of the Service Commission) Rules, 1992, as succeed for time to time.

(1) Recruitment by promotion shall be made on the basis of the criterion laid down in the Uttar Pradesh Government Servants criterion for Recruitment by Promotion Rules, 1994 as amended from time to time, through the Selection Committee constituted in accordance with the provisions of the Uttar Pradesh Constitution of Departmental Promotion Committee for posts outside the purview of the Service Commission Rules, 1992, as amended from time to time.

       

Note.—Nomination of officers for giving representation to the Scheduled Castes, Scheduled Tribes and Other Back-ward Classes of Citizens in the Selection Committee shall be made in accordance with the order made under section 7 of the Uttar Pradesh Public Services (Reservation for Scheduled Castes, Scheduled Tribes and Other Backward Classes) Act, 1994, as amended from time to time.

8. Amendment of Rule 23.—In the said rules, in rule 23, for existing sub-rule (2) set out in Column-1 below, the sub-rule as set out in Column-2 shall be substituted, namely—

9. Omission of Rule 25.—In the said rules, rule 25 shall be omitted.
