(Sixth Amendment) Rules, 2011

In pursuance of the provisions of clause (3) of article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of notification No. 2882/Sec-2-Five-2011-7(47)-11, dated May 27, 2011 :

In exercise of the powers conferred by the proviso to Article 309 of the Constitution the Governor is pleased to make the following rules with a view to amending the Uttar Pradesh Medical and Health Service Rules, 2004 :

The Uttar Pradesh Medical and Health Service
(Sixth Amendment) Rules, 2011

1. Short title and commencement.—(1) These rules may be called the Uttar Pradesh Medical and Health Service (Sixth Amendment) Rules, 2011.

(2) They shall come into force at once.

2. Amendment of Rule 3.—In the Uttar Pradesh Medical and Health Service Rules, 2004, hereinafter referred to as the said rules, in rule 3, for the existing clauses (c), (g) and (1)
set out in column 1 below, the clauses as set out in column 2 shall be substituted,
namely—

(c) ‘Additional Director (Male/Female)' includes Additional Director, Chief Consultant, Superintendent in Chief;

(c) ‘Additional Director’ includes Additional Director, Chief Consultant, Superintendent in Chief;

(g) ‘Consultant (Male/Female)’ includes Superintendent, Consultant, Deputy Chief Medical Officer, Deputy District Project Officer (Family Welfare) and any other officer in the pay-scale of Consultant;

(g) ‘Consultant’ includes Superin-tendent, Consultant, Deputy Chief Medical Officer and any other officer in the pay-scale of Consultant;

(1) ‘Joint Director (Male/Female)’ includes Chief Medical Superintendent Senior Consultant, Chief Medical Officer, District Project Officer (Family Welfare), Additional Chief Medical Officer and any other officer in the pay-scale of Joint Director;

(1) ‘Joint Director’ includes Chief Medical Superintendent, Senior Consultant, Chief Medical Officer, Additional Chief Medical Officer and any other officer in the pay-scale of Joint Director;

3. Substitution of Rule 4.—In the said rules, for existing rule 4 set out in column 1 below, the rule as set out in column 2 shall be substituted, namely—

4. Cadre of Service.—(1) (i) There shall be two cadres Service namely made and female cadres in the service for the post carrying the following pay scales :

(a) the appointing Authority may leave unfilled or the Governor may hold in abeyance any vacant post, without thereby entitling any person to compensation, or

(ii) Male and Female cadres referred to in clause (i) above shall be unified on the post of Director.

(b) the Governor may create such additional permanent or temporary posts as he may consider proper.

 

(2) (i) The strength of the service and of each category of posts therein shall be such as may be determined by the Government from time to time.

(ii) The strength of the service and of each category of posts therein shall, until orders varying the same are passed under clause (i) be as given in the Appendix : Provided that :

(a) the appointing authority may leave unfilled or the Governor may hold in abeyance any vacant post, without thereby entitling any person to compensation; or

(b) the Governor may create such additional permanent or temporary posts as he may consider proper.

Note.—The Government order No. 1694/5-9-2010-9(162)10, Dated October 14, 2010, by which the designations of District Project Officer (Family Welfare) and Deputy District Project Officer (Family Welfare) were changed as Chief Medical Officer (Family Welfare) and Deputy Chief Medical Officer (National Rural Health Mission) respectively has been cancelled and the arrangement as it existed prior to the date of issuance of Government order No. 1570/Sec-2-five-10-7(109)/10, dated May 5, 2010 has been restored vide Government Order No. 1910/Sec-2-five-117 (86)/11, dated April 7, 2011.

 

               

4. Substitution of Rule 5.—In the said rule, for existing rule 5 set out in column 1 below, the rule as set out in column 2 shall be substituted, namely—

5. Source of recruitment.—Recruitment to the various categories of posts in the service shall be made from the following sources—

(i) Director General-By promotion from amongst substantively appointed Directors.

(ii) Director-By promotion from amongst substantively appointed additional Directors, (Male/Female) who have completed two year’s service as such and have completed a total twenty six year’s service in the cadre on the first day of the year of recruitment.

(ii) Director-By promotion from amongst substantively appointed Additional Directors, who have completed two year’s service as such and have completed a total twenty six year’s service in the cadre on the first day of the year of recruitment.

(iii) Additional Director, (Male)-By promotion from amongst persons who are substantively appointed to the posts mentioned at the serial No. 1 (iv) of the Appendix and have completed five years service as such or have completed a total twenty four years service in the cadre on the first day of the year of recruitment.

(iii) Additional Director-By promotion from amongst persons who are substantively appointed to the posts mentioned at serial No. 1 (4) of the Appendix and have completed five years service as such or have completed a total twenty four years service in the cadre on the first day of the year of recruitment.

(iv) Additional Director (Female)-By promotion from amongst persons who are substantively appointed to the posts mentioned at serial No. 2 (iv) of the Appendix and have completed five years service as such or have completed a total twenty four years service in the cadre on the first day of the year of recruitment.

(iv) Joint Director-By promotion from amongst persons who are substantively appointed to the posts mentioned at serial No. (3) of the Appendix and have completed six year’s service as such or, have completed a total seventeen year’s service in the cadre on the first day of the year of recruitment.

(v) Joint Director (Male)-By promotion from amongst persons who are substantively appointed to the posts mentioned at serial No. 1 (iii) of the Appendix and have completed six year’s service as such or, have completed a total seventeen year’s service in the cadre on the first day of the year of recruitment.

(v) Consultant-By promotion from amongst persons who are substantively appointed to the posts mentioned at serial No. (2) of the Appendix and have completed six year’s service as such or have completed a total eleven year’s service in the cadre on the first day of the year of recruitment.

(vi) Joint Director (Female)-By promotion from amongst persons who are substantively appointed to the posts mentioned at serial No. 2 (iii) of the Appendix and have completed six year’s service as such or, have completed a total seventeen year’s service in the cadre on the first day of the year of recruitment.

(vi) Senior Medical Officer-By promotion from amongst persons who are substantively appointed to the post mentioned at serial No. (1) of the Appendix and have completed four years service as such on the first day of the year of recruitment.

(vii) Consultant (Male)-By promotion from amongst persons who are substantively appointed to the posts mentioned at serial no.1(ii) of the Appendix and have completed six year’s service as such or, have completed a total eleven year’s service in the cadre on the first day of the year of recruitment.

(vii) Medical Officer-By direct recruitment through the Commission :

(viii) Consultant (Female)-By promo-tion from amongst persons who are substantively appointed to the posts mentioned at serial No. 2(ii) of the Appendix and have completed six year’s service as such or, have completed a total eleven year’s service in the cadre on the first day of the year of recruitment.

 

(ix) Senior Medical Officer (Male)-By promotion from amongst persons who are substantively appointed to the post mentioned at serial No. 1 (i) of the Appendix and have completed four year’s service as such on the first day of the year of recruitment.

 

(x) Senior Medical Officer (Female)-By promotion from amongst persons who are substantively appointed to the post mentioned at serial No. 2 (i) of the Appendix and have completed four year’s service as such on the first day of the year of recruitment.

 

(xi) Medical Officer (Male)-By direct recruitment through the Commission :

Provided that all Medical Officers to be appointed on or after December 1, 2010 after selection by the Commission will have to complete four years service at Community Health Centres, Primary Health Centres and Additional Primary Health Centres for promotion from the post of Senior Medical Officer to the post of Consultant :

Provided further that in case such a Medical Officer is posted to a Community Health Centre, Primary Health Centre and Additional Primary Health Centre in a Backward Block as specified in Appendix ‘A’, for a period of two years then such period shall suffice for promotion from the post of Senior Medical Officer to the post of consultant :

Provided further that in case such a Medical Officer is posted to a Community Health Centre, Primary Health Centre and Additional Primary Health Centre in a Backward Block as specified in Appendix ‘A’, for a period of two years then such period shall suffice for promotion from the post of Senior Medical Officer to the post of consultant :

Provided also that other conditions for promotion to the post of Consultant shall remain unchanged.

5. Substitution of Rule 8.—In the said rules, for existing rule 8 set out in column 1 below, the rule as set out in column 2 shall be substituted, namely—

8. Academic qualification.—A candi-date for direct recruitment to various posts in the Male and Female Cadres of the service must possess M.B.B.S. degree of a University recognized by the Medical Council of India. A candidate who possesses a post-graduate Degree/Diploma in Medical or Health Sciences in a particular subject of a University recognized by the Medical Council of India or the Uttar Pradesh Medical Council shall be given preference in the matter of direct recruitment.

8. Academic qualification.—A candi-date for direct recruitment must possess M.B.B.S. degree of a University recognized by the Medical Council of India. A candidate who possess a post-graduate Degree/ Diploma in Medical or Health Sciences in a particular subject of a University recognized by the Medical Council of India or the Uttar Pradesh Medical Council shall be given preference in the matter of direct recruit-ment.

6. Amendment of Rule 18.—In the said rules, in rule 18, for existing sub-rules (1)
and (2) set out in column 1 below, the sub-rules as set out in column 2 shall be substituted namely—

(1) A person on substantive appointment to the post of—

(a) Medical Officer Male or Female shall be placed on probation for a period of two years,

(b) Senior Medical Officer, Senior Specialist, Consultant, Superintendent, Deputy C.M.O. Joint Director or Additional Director or equivalent post shall be placed on probation for a period of one year, and

(c) Director or Director-General shall be placed on probation for a period of six months.

(2) The appointing authority may, for reasons to be recorded, extend the period of probation in individual cases specifying the date upto which the extension is granted :

Provided that, save in exceptional circumstances, the period of probation—

7. Amendment of Rule 21.—In the said rules, in rule 21, for existing sub-rule (2) set out in column 1 below, the subrule as set out in column 2 shall be substituted, namely—

(2) The scales of pay at the time of the commencement of the Uttar Pradesh Medical and Health Service (Third Amendment) Rules, 2009 are given in Appendix.

(2) The scales of pay at the time of the commencement of the Uttar Pradesh Medical and Health Service (Six Amendment) Rules, 2011 are given in Appendix.
