In pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of notification No. 803/One-13-2011-20(2)-89-11, dated July 18, 2011—

In exercise of the powers conferred by the proviso to Article 309 of the Constitution, the Governor is pleased to make the following rules with a view to amending the Uttar Pradesh Land Acquisition (Revenue Department) Ministerial Service Rules, 1993.

1. Short title and commencement.—(1) These rules may be called the Uttar Pradesh Land Acquisition (Revenue Department) Ministerial Service (First Amendment) Rules, 2011.

(2) They shall come into force at once.

2. Amendment of Rule 4.—In the Uttar Pradesh Land Acquisition (Revenue Department) Ministerial Service Rules, 1993, hereinafter referred to as the said rules, in rule 4, after existing sub-rule (2), the following new sub-rule (3) shall be inserted, namely—

“(3) The cadre of the services shall be of state level”.

3. Amendment of Rule 5.—In the said rules, in rule 5, for existing sub-rule (1) set out in Column-1 below, the sub-rule set out in Column-2 shall be substituted, namely—

(1) Recruitment to the post of Junior Clerk and Ahalmad shall be made as follows—

(1) Recruitment to the post of Junior Clerk and Ahalmad shall be made as follows—

(i) 85% by direct recruitment;

(i) 80% by direct recruitment;

(ii) 15% by promotion from amongst the substantively appointed Group ‘D’ employees who have completed five years service as such, on the first day of the year of recruitment and who must have passed High School Examination from the Board of High School and Intermediate education, Uttar Pradesh or an Examination recognized by the Government as equivalent thereto.

(ii) 20% by promotion from amongst substantively appointed Group ‘D’ employees in accordance with the Uttar Pradesh Subordinate Officers Ministerial Group ‘C’ Posts of the Lowest grade (Recruitment by Promotion) Rules, 2001, as amended from time to time.

4. Substitution of Rule 10.—In the said rules, for existing Rule 10 set out in Column-1 below, the rule as set out in Column-2 shall be substituted, namely—

10. Age.—A candidate for direct recruitment must have attained the age of 18 years and must not have attained the age of more than 32 years on the first day of July of the year in which vacancies for direct recruitment are advertised :

Provided that the upper age limit in the case of candidates belonging to the Scheduled Castes, Scheduled Tribes and such other categories as may be notified by the Government from time to time shall be greater by such number of years as may be specified.

5. Amendment of Rule 14.—In the said rules, in rule 14, for existing sub-rule (2) set out in Column-1 below, the sub-rule as set out in Column-2 shall be substituted, namely—

(2) The Director shall notify to the Employment Exchange in accordance with rules and orders for the time being in force, the number of vacancies to be filled during the course of the year as also the number of vacancies to be reserved for candidates belonging to Scheduled Castes Scheduled Tribes and other categories under rule 6.

(2) The vacancies to be filled by direct recruitment shall be notified by the Director in the following manner—

(i) by issuing advertisement in daily newspaper having wide circulation;

(ii) by passing the notice on the notice board of the office or by advertising through Radio/Television and other employment newspaper; and

(iii) by notifying vacancies to the Employment Exchange.

6. Substitution of Rule 15.—In the said rules, for existing Rule 15 set out in Column-1 below, the rule as set out in Column-2 shall be substituted, namely—

15. (1) For the purpose of recruitment there shall be constituted a Selection Committee in accordance with the Subordinate Offices Ministerial Staff (Direct Recruitment) Rules, 1985, as amended from time to time.

15. Direct recruitment to the posts of Junior clerk and Ahalmad shall be made in accordance with the provisions of the Uttar Pradesh Procedure for Direct Recruitment for Group ‘C’ Posts (outside the Purview of the Uttar Pradesh Public Service Commission) rules, 2002, as amended from time to time.

(2) The Selection Committee shall Scrutinize the applications and require the eligible candidates to appear in a competitive examination and interview.

 

(3) After the marks obtained by the candidates in written test have been tabulated, the Selection Committee shall, having regard to the need for the securing due representation of the candidates belonging to the Scheduled Castes, Scheduled tribe and other categories in accordance with rule 6, call for interview such number of candidates as on the result of the written examination, have come up the standard fixed by the committee in this respect. The marks awarded to each candidate in the interview shall be added to the marks obtained by him in the written test.

 

(4) The Selection Committee shall prepare a list of candidate in order of merit as disclosed by aggregate of marks obtained by them in the written test and interview. It two of more candidate obtained equal marks the candidate obtaining higher marks in written test shall be placed higher. The number of the names in the list shall be larger (but not larger by more than 25%) than the number of the vacancies.

 

7. Insertion of new rule.—In the said rules, after existing rule 15, the following new rule 15-A shall be inserted, namely—

“Procedure for recruitment by promotion to the posts of Junior Clerk and Ahalmad”.

15-A. Recruitment by promotion to the posts of Junior Clerk and Ahalmad shall be made in accordance with the provisions of the Uttar Pradesh Subordinate Offices Ministerial Group “C” Posts of the Lowest Grade (Recruitment by Promotion) Rules, 2001, as amended from time to time.

8. Amendment of rule 16.—In the said rules, in rule 16—

(a) for the existing marginal heading set out in Column-1 below, the marginal heading as set out in Column-2 shall be substituted, namely—

(1) Recruitment by promotion shall be made on the basis of seniority subject to rejection of unfit through the Departmental Selection Committee comprising—

(1) Recruitment by promotion to the posts other than the posts of Junior Clerk and Ahalmad shall be made on the basis of the criterion laid down in the Uttar Pradesh Government Servants Criterion for Recruitment by Promotion Rules, 1994.

(a) Appointing Authority Chairman

 

(b) Two Gazetted officers—

nominated by the appointing authority, having supervisory capacity of the post for which selection is made,—Members

as amended from time to time, through the Selection Committee constituted in accordance with the provisions of the Uttar Pradesh Constitution of Departmental Promotion Committee for Posts outside the purview of the Service Commission Rules, 1992, as amended from time to time.

 

Note.—Nomination of officers for giving representation to the Scheduled Castes, Scheduled Tribes and Other Back- Ward Classes of citizens in the Selection Committee shall be made in accordance with the order made under section 7 of the Uttar Pradesh Public Service (Reservation for Scheduled Castes, Scheduled Tribes and Other Backward Classes) Act, 1994, as amended from time to time.

9. Amendment of Rule 18.—In the said rules, in rule 18, for existing sub-rule (1) set out in Column-1 below, the sub-rule as set out in Column-2 shall be substituted, namely—

(1) Subject to the provisions sub-rule (2), the Director shall forward the requisite number of names from the lists prepared under rules 16 and 17 to the appointing authority from whom the requisition of vacancies are received under rule 14, who shall make appointment in the order in which they stand in the list.

10. Amendment of Rule 22.—In the said rules, in rule 22, for existing sub-rule (2) set out in Column-1 below, the sub-rule as set out in Column-2 shall be substituted, namely—

11. Omission of Rule 24.—In the said rules, the existing rule 24 shall be omitted.

12. Insertion of new Rule 29.—In the said rules, after existing rule 28, the following new rule 29 shall be inserted, namely—

29. “Transfer”.The Director may transfer a member of the service from one district to another district as per Government orders issued from time to time in this regard.

The Collector of the district may transfer a member of the service within the district.”
