U.P. Police Service (Twelth Amendment) Rules, 2011

In pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of notification No. 2032-VI-P.S.-1-2011-622(1)-2007, dated September 7, 2011—

In exercise of the powers conferred by the proviso to Article 309 of the Constitution, the Governor is pleased to make the following rules with a view to amending the Uttar Pradesh Police Service Rules, 1942.

The Uttar Pradesh Police Service (Twelth Amendment) Rules, 2011

An further to amend the Administrators-General Act, 1963 in its application to Uttar Pradesh.

It is hereby enacted in the Sixty-second Year of theRepublicofIndiaas follow—

1. Short title and commencement.—(1) These rules may be called the Uttar Pradesh Police Service (Twelth Amendment) Rules, 2011.

(2) They shall come into force at once.

2. Substitution of Rule 5.—In the Uttar Pradesh Police Service Rules, 1942, hereinafter referred to as the said rules, for existing rule 5 set out in column-I below, the rule as set out in column-2 shall be substituted, namely—

5. Source of Recruitment.—Recruitment to the service in the ordinary grade shall be made—

Note.—A Combined Competitive Examination is held by the Commission for recruitment to the Uttar Pradesh Civil Service (Executive Branch), Uttar Pradesh Police Service, Uttar Pradesh Finance and Account Service, etc.

Provided that the Governor may also in the interest of Public service, sanction the appointment in the temporary of officiating vacancies, of Sub-Inspectors of Police, who have been approved for substantive appointment as Inspectors of Police and have officiated as Inspectors for not less then two years:

Provided further that two percent of the vacancies for a year of recruitment may be filled by out of turn promotion through the Commission on specific recommendation of the Government from amongst such police Inspectors/Company Commanders of the Uttar Pradesh Police Force who exhibit great Courage and gallantry in encounter or arrest of notorious terrorists or who take great personal risk of life in the discharge of their duties. If such person of sufficient number of such persons are not available for out of turn promotion under this proviso, the remaining vacancies shall be filled in accordance with the general procedure prescribed in this rule. The out of turn promotion quota shall remain included in the overall strength of the cadre for the purpose of computing reservation under rule 6.

Provided further that two percent of the vacancies for a year of recruitment may be filled by out of turn promotion through the Commission on specific recommendation of the Government from amongst such police Inspectors/Company Commanders of the Uttar Pradesh Police Force who exhibit great Courage and gallantry in encounter or arrest of notorious terrorists or who take great personal risk of life in the discharge of their duties. If such person of sufficient number of such persons are not available for out of turn promotion under this proviso, the remaining vacancies shall be filled in accordance with the general procedure prescribed in this rule. The out of turn promotion quota shall remain included in the overall strength of the cadre for the purpose of computing reservation under rule 6 :

 

Provided also that two per cent of the vacancies for a year of recruitment may be filled by out of turn promotion through the Commission on the Specific recommen-dation of the Government from amongst such Police Inspectors/Company Comman-ders of Uttar Pradesh Police Force who have achieved the following awards—

 

(a) After having been selected to the Indian team should have participated in World Championship, either in a team or individual event, which is recognized by the International Olympic Association and should have earned a Gold or Silver or Bronze Medal or up to the fourth place,

 

Or

 

(b) After having been selected to the Indian team should have participated in Olympic Games which is recognized by the International Olympic Association and should have earned a Gold or Silver or Bronze Medal or up to the fourth place,

 

Or

 

(c) After having been selected to the Indian team should have participated in Asian Games/Asian Championship, which is recognized by the International Olympic Association and should have earned a Gold or Silver Medal,

 

Or

 

(d) If he/she has earned country’s highest award or excellence in sports “Arjuna Award”/“Rajeev Gandhi Khel Ratna”.

 

If any Police Inspector/Company Commander rank sports person qualifies the criterion laid down for promotion in such case then a proposal of promotion would be forwarded to the Government by the Director General of Police, Uttar Pradesh with clear recommendation and the out of turn promotion will be awarded by the State Government with the concurrence of the Uttar Pradesh Public Service Commission.

 

If such person or sufficient numbers of such persons are not available for out of turn promotion under this proviso, the remaining vacancies shall be filled in accordance with the general procedure prescribed in this rule. The out of turn promotion quota shall remain included
in the overall strength of the cadre for
the purpose of computing reservation under rule 6.

3. Substitution of Rule 25.—In the said rules, for existing rule 25 set out in Column-1 below, the rule as set out in Column-2 shall be substituted, namely :

Scale of Pay 25.—The scale of pay admissible to a person appointed to a post in the cadre of the service, whether in a substantive or officiating capacity or as a temporary measure, shall be as follows—

4. Substitution of Rule 26.—In the said rules, for existing rule 26 set out in Column-1 below, the rule as set out in Column-2 shall be substituted, namely :

(1) Criteria for crossing efficiency bar—

No person shall be allowed to cross efficiency bar unless :

Procedure for Selection to Senior Scale, Additional Superintendent of Police, Additional Superintendent of Police, Special Grad-II and Additional Superintendent of Police Special Grade-I.

(i) he has a satisfactory record of service;

 

(ii) he is fully capable of supervising the work of his subordinates and the investigation of heinous crimes;

 

(iii) he is found to be fully capable of holding charge of a circle by reason both of his ability and strict honesty; and

 

(iv) his integrity is certified.

 

(2) (a) Selection to the Senior Scale shall be made on the recommendations of a selection committee on the basis of seniority subject to the rejection of the unfit from amongst such substantively appointed Deputy Superintendents of Police who have completed six years service from the year of allotment on the date of selection and have also completed four years in ordinary grade and are also confirmed in the Uttar Pradesh Police Service. The Selection Committee shall be constituted as follows :

(1) (a) Selection to the Senior Scale shall be made on the recommendations of a selection committee on the basis of criterion laid down in the Uttar Pradesh Government Servants Criterion for Recruitment by Promotion Rules, 1994 as amended from time to time from amongst such substantively appointed Deputy Superintendents of Police who have completed six years service from the year of allotment on the date of selection and have also completed four years in ordinary grade and are also confirmed in the Uttar Pradesh Police Service. The Selection Committee shall be constituted as follows :

Provided that if the Selection Committee so constituted does not include persons each belonging to Scheduled Castes/Scheduled Tribes and Backward Classes then an officer not below the rank of Special Secretary to the Government belonging to such Castes/Tribes and Classes as are not represented in the Selection Committee shall be nominated as a member of the Selection Committee.

Provided that if the Selection Committee so constituted does not include persons each belonging to Scheduled Castes, Scheduled Tribes and Backward Classes then an officer not below the rank of Special Secretary to the Government belonging to such Castes/Tribes and Classes as are not represented in the Selection Committee shall be nominated as a member of the Selection Committee.

Note.—‘Backward Classes’ means the backward classes of citizens specified in Schedule-I of the Uttar Pradesh Public Services (Reservation for Scheduled Castes, Scheduled Tribes and Other Backward Classes) Act, 1994, as amended from time to time.

(b) The Head of Department shall prepare an eligibility list of candidates in accordance with the Uttar Pradesh Promotion by Selection (on the posts outside the purview of the Public Service Commission) Eligibility List Rules, 1986, as amended from time to time and place it before the Selection Committee along with their character rolls and such other records, pertaining to them as may be considered proper.

(b) The Head of Department shall prepare an eligibility list of candidates in accordance with the Uttar Pradesh Promotion by Selection (on the posts outside the purview of the Public Service Commission) Eligibility List Rules, 1986, as amended from time to time and place it before the Selection Committee along with their character rolls and such other records, pertaining to them as may be considered proper.

(c) The Selection Committee shall consider the cases of candidates on the basis of records, referred to in clause (b) and if it considers necessary, it may interview the candidates also.

(d) The Selection Committee shall prepare a list of selected candidates in accordance with the orders of the State Government in force at the time of recruitment and forward the same to the appointing authority.

(3) (a) Selection to the Additional Superintendent of Police Grade-II shall be made on the recommendation of a Selection Committee on the basis of seniority subject to the rejection of the unfit from amongst substantively appointed officers who have completed ten years service from the year of allotment on the date of selection and have completed eight years of Uttar Pradesh Police Service on the first day of July of the year of selection. The Selection Committee shall be constituted as follows—

(2) (a) Selection to the Additional Superintendent of Police shall be made on the recommendations of a Selection Committee on the basis of criterion laid down in the Uttar Pradesh Government Servants Criterion for Recruitment by Promotion Rules, 1994, as amended from time to time from amongst substantively appointed officers who have completed twelve years service on the first day of July of the year of selection.  The Selection Committee shall be constituted as follows—

(i) Chief Secretary to the Government

of July of the Year of selection. The Selection Committee shall be constituted as follows—

(4) (a) Selection to the Additional Superintendent of Police Special Grade-I shall be made on the recommendation of a Selection Committee on the basis of criterion laid down in the Uttar Pradesh Government Servants Criterion for Recruitment by Promotion Rules, 1994, as amended from time to time from amongst such substantively appointed Additional Superintendent of Police Special Grade-II who have completed twenty one years service in the Uttar Pradesh Police Service. The Selection Committee shall be constituted as follows—

(ii) Principle Secretary or Secretary to the Government in Home Department         Member

 

(iii) Principle Secretary or Secretary to the Government in Personnel Department

        Member

 

(iv) Director General of Police, Uttar Pradesh                                                  Member

 

Provided that if the Selection Committee so constituted does not include persons each belonging to Scheduled Castes/Scheduled Tribes and Backward Classes then an officer not below the rank of Special Secretary to the Government belonging to such Castes/Tribes and Classes as are not represented in the Selection Committee, shall be nominated as a member of the Selection Committee.
